Terms & Conditions

1. This competition will be governed by these terms and conditions and entrants agree that they have read and understood these terms and conditions and will be bound by them.

2. For the avoidance of doubt, submission of content and use of the Show Us website will also be subject to any terms and conditions which you accept to be bound by as part of the registration process for use of this website.

3. Entrants may enter the competition by submitting one or more entries on the subject of knife crime, whether videos, artwork or creative writing, either by uploading them to the website www.mtv.co.uk/showus or by posting them to Show Us Competition, MTV Networks Europe, 17-29 Hawley Crescent, London N1 8TT. Costs to enter the competition via the Internet may vary so please check with your network operator for current charges. Those entrants entering via the website should seek the permission of the person paying the bill before entering. Those entrants entering via post are responsible for paying sufficient postage on their entry.

4. Entries must be original to the entrant and must not contain any material which any third party has any rights in or to, such as samples from any commercial music;

5. The closing date for entries is 11.59pm on 31 December 2008.

6. This competition is open to residents of the UK and Ireland only, excluding employees and immediate relatives of employees of MTV Networks Europe (the “Promoter”) and/or COI or of their respective parents, subsidiaries or affiliated companies or any other person professionally connected with this competition.

7. Entries must include name, age, address, (including postcode), telephone number of entrant.

8. A shortlist of twenty (20) entrants (the “Shortlisted Entrants”) will be selected by MTVNE on 8 January 2009.

9. Shortlisted Entrants will be notified by telephone or email on 15 January 2009.

10. The Shortlisted Entrants will be invited with one guest to attend the Show Us What You’re Made Of event at a venue in central London to be held on or before 1 March 2009 (the “Event”) where their entries will be displayed. Shortlist Entrants shall be notified of the date and venue of the Event on 15 January 2009. Shortlisted Entrants aged sixteen (16) or under must be accompanied by an adult.

11. The four (4) winners (the “Winners”) selected by an independent judging panel will be announced at the Event. If Winners are unable to attend the Event they will be notified within three (3) working days of the Event.

12. The Winners will win equipment to the value of one thousand pounds sterling (£1,000). To claim this prize, Winners must request from MTV equipment relevant to the artistic medium used to produce their entry and MTV will then purchase the requested equipment, or issue vouchers for the purchase of that equipment.

13. In the event that the Event falls within school term-time, the Shortlisted Entrants must obtain the prior written consent of their headteacher and their parent/legal guardian for their absence from school.

14. If the Shortlisted Entrants are not available on the date of the Event as notified to them by MTVNE no alternative dates shall be available.

15. For the avoidance of doubt, the prizes do not consist of anything other than expressly set out in paragraph 12 above and no additional costs (including, without limitation, spending money are included).

16. In respect of all entrants under the age of 18, all prizes are subject to the applicable winner first printing off these terms and conditions, obtaining the relevant signatures from their parent or legal guardian and sending the signed document to Show Us Competition, MTV Networks Europe, 17-29 Hawley Crescent, Camden Lock, London NW1 8TT.

17. The Winners are responsible for all applicable taxes and expenses not specified in the prize description.

18. The Winners will receive full details of the prize by telephone, post or e-mail within five (5) days of the Event. The first prize winner(s) shall receive their prizes in the post within twenty eight (28) days of the Event.

19. The Promoter’s decision is final with respect to any aspect of the competition, including the determination of any winner of a prize. No correspondence will be entered into.

20. Entrants agree that the Promoter may use the entrant’s entry, name and/or likeness, voice, photographs and/or video footage of the entrant, biographical information provided by the entrants and/or any statement made by them concerning the competition and/or the prize(s) in connection with publicizing the competition, in any and all media in perpetuity throughout the world as the Promoter in its sole discretion sees fit.

21. By entering this competition, all entrants hereby grant the Promoter the exclusive right to film, tape, sound record and photograph all their activities in connection with the competition and (if applicable) any prizes. Everything filmed, taped or recorded by the Promoter shall be known as “Footage”.

22. All entrants hereby irrevocably and unconditionally assign to the Promoter with full title guarantee (and by way of present assignment of present and future rights) all intellectual property rights in any “Footage” throughout the world for the full unexpired period of such rights and all renewals, reversions and extensions of such period as may be provided under any applicable law throughout the world.

23. All entrants hereby irrevocably and unconditionally waive in favour of the Promoter, the Promoter’s affiliates and their licensees, assigns and successors in title, all moral rights in any “Footage” to which he or she is, or may at any time in the future be, entitled.

24. By entering the competition all entrants grant to the Promoter and/or COI a non-exclusive, worldwide, irrevocable, sub-licensable right to use any material submitted by entrants in connection with this competition (including but not limited to photographs, musical compositions, audio and audiovisual recordings and text) (“Submitted Material”), without payment to the entrant or any third party, in any and all media in perpetuity throughout the world on a royalty free basis (ie without payment to the entrant or any third party) as the Promoter and/or COI in their sole discretion see fit.

25. Entrants irrevocably and unconditionally waive any “moral” or like rights in any Submitted Material, or where such waiver is not possible, entrants agree not to assert such rights for the purposes of it being used in accordance with these Terms and Conditions. Moral rights include the right to be identified as the author and the right to object to derogatory treatment of any Submitted Material.

26. Each entrant undertakes that:

• they are the only creator, author and owner of the material they submit on entering the competition or, if they are not the exclusive owner, they have received written consent from the owner to submit the material and to grant to the the rights to use and to sub-license the Submitted Material as set out above.

• the use of Submitted Material by the Promoter and/or COI and/or any other sub-licensee will not infringe any intellectual property or other rights of any third party (for example trade marks, copyright, privacy rights etc). Entrants whose Submitted Material contains any underlying copyrights such as music, lyrics, film footage, artwork or other copyright material owned by any other person, confirm that they have obtained all necessary consents in writing necessary for the Promoter and/or COI and/or any other sub-licensee to use the Submitted Material as set out above.

• the Submitted Material does not contain anything that is defamatory, offensive or illegal.

• the Submitted Material is free from any right or claim by anyone under any recording contract, publishing contract, or any union, guild or collecting society such as, but not limited to, the Performing Right Society. Entrants agree to inform the Promoter immediately if this status changes.

27. The Promoter reserves the right to select an alternative Shortlisted Entrant and/or Winner in the event that the Promoter has reasonable grounds for believing that a selected winner has contravened any of these Terms and Conditions.

28. The Winners may be required to provide a written acknowledgement of acceptance of all terms and conditions of the competition along with a parent’s or legal guardian’s signature prior to receiving their prize.

29. The Promoter can accept no responsibility for entries lost, delayed, misdirected, damaged or undelivered. Incomplete and/or illegible entries will be disqualified. The Promoter shall not be responsible for technical errors in telecommunications networks, Internet access or otherwise preventing entry to any competition. The Promoter shall not be responsible for technical errors, postal strikes, postal delays or insufficient payment of postage preventing entry to the competition.

30. The prizes are as stated and are non-transferable. No cash alternatives will be offered. If due to circumstances beyond the Promoter’s control the Promoter is unable to provide any stated prize(s), the Promoter reserves the right to award a substitute prize of equal value. All prizes are subject to the additional terms and conditions of the manufacturer or supplier.

31. By entering the competition, entrants acknowledge that they may be required to be used in publicity without further consent or payment. Such publicity may include without limitation the entrant’s name and/or likeness, voice, photographs and/or video footage of the entrant, biographical information provided by the entrants and/or any statement made by them concerning the competition and/or the prize(s). Entrants agree that any or all such elements may be used by the Promoter in any and all media in perpetuity throughout the world as the Promoter in its sole discretion sees fit.

32. The Promoter shall not be liable to the Shortlisted Entrants or Winners and/or any guests and/or parents/legal guardians for any loss or damage howsoever caused (whether in contract, tort or statutory duty or otherwise) arising out of or in connection with the competition and/or prize other than death or personal injury caused by negligence of the Promoter and/or the Promoter’s personnel and/or deceit or fraud by Promoter and/or Promoter’s personnel.

33. The Promoter shall not be liable for any delay in performing or partial or total failure to perform any of its obligations to the Shortlisted Entrants or Winners and/or any guests and/or parents/legal guardians under these Terms and Conditions if such delay or failure is caused by circumstances beyond its reasonable control including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation as a result of war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes or arising without limitation out of or in connection with (i) the activities of third party event organisers; (ii) any form of transportation (including but not limited to flights, trains, coaches, buses, ferries, taxis or cars); and/or (iii) by third parties providing accommodation included in the prize. For the avoidance of doubt, the affected Shortlisted Entrants or Winners and/or any guests and/or parents/legal guardians shall be solely liable for any additional costs incurred as a result.

34. A list of the Shortlisted Entrants and Winners can be obtained by sending a stamped, self- addressed envelope to MTV Networks Europe, Show Us Competition, PO BOX 1381, London, NW1 8XT, for one (1) month after the competition closes.

35. Any personal information, including without limitation, the entrant's name, age, address (including postcode), telephone number and/or email address will be used solely in connection with this competition and as set out in these Terms and Conditions and will not be disclosed to any third party, except for the purpose of fulfilling the prize(s) where applicable. Any personal information held by the Promoter in respect of any competition will be held on record for a short period for the purpose of ensuring fulfilment of the competition and then destroyed.

36. All entrants agree to be bound by these Terms and Conditions, which may be amended or varied at any time by the Promoter on notice.

37. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and the courts of England shall have exclusive jurisdiction in relation to any disputes arising therefrom.

2. I have read these Show Us Competition Terms and Conditions and understand what is required of the Entrant under it. I unconditionally guarantee the Entrant’s compliance with his/her obligations and duties to MTV Networks Europe under it and confirm that these Terms and Conditions are beneficial for the Entrant.
